These Terms of Use ("Terms") are a legal agreement between you and Nicholas Easton (ABN 31 978 335 623), a sole trader based in Victoria, Australia ("we", "us", "our"), for the ScanRise app ("the app"). By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in line with the App Store terms and these Terms.
ScanRise helps you wake up, but you should not rely on it as your only alarm for anything critical (work, flights, medication, appointments). Mobile operating systems can delay, silence, or prevent third-party alarms — for example if the device is off, muted, in a low-power state, out of battery, or if the app is closed or restricted by the system. We do not guarantee that an alarm will sound, and we are not liable for any loss or missed event resulting from an alarm not functioning as expected. For anything you cannot afford to miss, use a backup (such as your device's built-in Clock alarm).
ScanRise's sleep-cycle guidance, wellness tracking, and related features are for general wellness and informational purposes only. ScanRise is not a medical device and does not diagnose, treat, cure, or prevent any condition. Sleep-cycle timing is an approximation based on population averages and will not be accurate for every individual. Consult a qualified healthcare professional for any sleep, health, or medical concern, and do not disregard professional advice because of anything in the app.
To dismiss an alarm, the app uses your camera to recognise an object on your device. No images or video are captured, stored, or transmitted. Your other data (settings, wellness entries, etc.) is stored on your device. Our handling of information is described in our Privacy Policy, which forms part of these Terms.
Don't misuse the app, reverse-engineer it, resell it, or use it unlawfully. We may suspend access for breach of these Terms.
The app and its content are owned by us or our licensors and protected by law. ScanRise uses open-source components (including TensorFlow.js and COCO-SSD under the Apache 2.0 licence, and the Poppins and DM Sans fonts under the SIL Open Font License); their licences are acknowledged accordingly.
The app is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for missed wake-ups or events (see section 2). Nothing in these Terms excludes rights that cannot be excluded under applicable law (including the Australian Consumer Law, where it applies).
We may update these Terms; continued use after changes means you accept them.
These Terms are governed by the laws of Victoria, Australia, and disputes are subject to the courts there, unless applicable consumer law provides otherwise.
